§ 1 Scope
These Terms and Conditions apply to all contracts concluded via jk3da.com between Jonas Kircher, Rathausstraße 88, 65203 Wiesbaden, Germany (hereinafter "Provider") and the customer.
The offering includes digital products (3D assets, textures, plugins, digital content) as well as individual services in the field of 3D art and game development.
§ 2 Subject Matter
(1) The Provider sells digital content delivered electronically (download products).
(2) Additionally, individual services (e.g. 3D modelling, asset creation, customisations) may be offered.
(3) The specific scope of services is defined by the respective product description or individual agreement.
§ 3 Contract Formation
(1) The display of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order.
(2) By clicking "Buy" and completing the payment process, the customer makes a binding offer to conclude a purchase contract.
(3) The contract is concluded upon receipt of the order confirmation email or provision of the download.
§ 4 Prices and Payment
(1) All prices are final prices including statutory VAT (19%).
(2) Payments are processed by Stripe Payments Europe Ltd., Dublin, Ireland.
(3) Accepted payment methods: credit card, SEPA direct debit, Klarna (where available).
(4) No additional fees are charged to the customer.
§ 5 Delivery of Digital Content
(1) Digital products are made available for download in the customer account after successful payment.
(2) Access to purchased content remains available as long as the customer account is active.
(3) Delivery is made exclusively electronically.
§ 6 Services (Freelance / Custom Work)
(1) Services are individually agreed and based on separate offers or communication between Provider and customer.
(2) Scope, price and delivery time are determined prior to commissioning.
(3) Unless otherwise agreed, these are services under contract for work (Werkvertrag).
(4) The right of withdrawal may be excluded by law for individually created services.
§ 7 Right of Withdrawal for Digital Products
(1) Consumers generally have a 14-day right of withdrawal.
(2) This right of withdrawal expires early for digital content if:
- the Provider has begun execution of the contract,
- the customer has expressly agreed that execution begins before the withdrawal period expires,
- and the customer has confirmed awareness that their right of withdrawal is lost upon commencement of the download.
(3) Consent is given during the ordering process before payment is completed.
§ 8 License & Usage Rights
(1) The purchase grants the customer a simple, non-transferable right of use.
(2) The Provider retains all copyrights.
(3) The following license models apply:
8.1 Personal License (non-commercial)
- Permitted: private projects and portfolio use
- Not permitted: commercial use, sold products or client projects
8.2 Commercial License
- Permitted: commercial games, apps and projects
- Permitted: freelance and client projects
- Permitted: publishing on platforms (e.g. Steam, App Store)
- Permitted: modification for own projects
- Not permitted: resale or redistribution of original files
- Not permitted: redistribution as a standalone asset or asset pack on marketplaces
Open-Source Exception: Where a product is released under an open-source license (e.g. GNU GPL v3.0), the terms of that license take precedence. The above restrictions do not apply to redistribution under the terms of the applicable open-source license.
§ 9 Warranty
Statutory warranty rights apply. In case of defects, the customer may request a corrected version or replacement delivery.
§ 10 Liability
(1) The Provider is only liable for intent and gross negligence.
(2) In cases of slight negligence, the Provider is only liable for breach of material contractual obligations.
(3) Liability for damages arising from improper use of digital content is excluded.
§ 11 Applicable Law
The law of the Federal Republic of Germany applies.
§ 12 Place of Jurisdiction
Place of jurisdiction is Wiesbaden, provided the customer is a merchant or has no general place of jurisdiction in Germany.
§ 13 Severability
(1) Should individual provisions of these Terms be invalid, the contract remains valid in all other respects.
(2) The invalid provision shall be replaced by the applicable statutory provision.
